With reference to the letters/representations cited above, I state that the court matter, wherein it is held that there is a statutory prohibition under Section 126 of the Indian Evidence Act, r/w. Rules framed under section 49(1)(c) of the Advocate Act, 1961, for any counsel, including the Public Prosecutor, to divulge any information, which they obtained during the professional work. Hence, I could not furnish the information required by you, under the RTI Act, 2005, which is related to the court matter.”

4052 - குற்றப் பின்னணி இல்லாத, தகுதி வாய்ந்த நபர்களையே, அரசு வழக்கறிஞர்களாக, மாநில அரசுகள் நியமிக்க வேண்டும், CIVIL APPEAL NO. 13727 OF 2015, November 26, 2015
'குற்றப் பின்னணி இல்லாத, தகுதி வாய்ந்த நபர்களையே, அரசு வழக்கறிஞர்களாக, மாநில அரசுகள் நியமிக்க வேண்டும்' என, சுப்ரீம் கோர்ட் அதிரடி உத்தரவு பிறப்பித்துள்ளது.
உத்தர பிரதேச மாநிலத்தில், மாவட்ட நீதிமன்ற அரசு வழக்கறிஞர்களுக்கு, அம்மாநில அரசு பணி நீட்டிப்பு வழங்க மறுத்தது. இதுதொடர்பான வழக்கில், அவர்களை மீண்டும் பணியில் அமர்த்தும்படி, அலகாபாத் ஐகோர்ட் உத்தரவிட்டது.
இதை எதிர்த்து தொடரப்பட்டமேல்முறையீட்டு மனுக்களை ஒன்றாக விசாரித்த, சுப்ரீம் கோர்ட் நீதிபதிகள், விக்ரம்ஜித் சென், ஏ.எம்.சப்ரே ஆகியோரைக் கொண்ட அமர்வு, அலகாபாத் ஐகோர்ட் வழங்கிய தீர்ப்பை ரத்து செய்தது.
பின், நீதிபதிகள் பிறப்பித்த உத்தரவு: மாவட்ட நீதிமன்றங்களில், கூடுதல் அரசு வழக்கறிஞர் மற்றும் அரசு வழக்கறிஞர்கள் நியமனம், தகுதி அடிப்படையில் தான் நடைபெற வேண்டும்.
